A ground lease, also known as a land lease (huurgrond), is a legal arrangement in which the landowner, referred to as the ‘lessor,’ leases the land to a tenant, known as the ‘lessee.’ This practice is common for business premises within the Dutch legal framework. However, in Curaçao, it’s also widely used for residential properties.
It’s crucial to note that under this agreement, the land and any permanent structures attached to it remain the private property of the landowner. Any sale, encumbrance of the property, or transfer of lease rights requires prior consent from the landowner. Furthermore, using the land for commercial or industrial purposes is not permitted unless the landowner grants explicit approval. These conditions are explicitly outlined and governed by the Terms of Lease.
