RESIDENCE PERMIT

At our law firm, we are experts in handling residence permit applications for foreign nationals in Curaçao. With years of experience, we understand the various types of residence permits and their specific requirements and specifications. U.S. and Dutch nationals have the unique advantage of being able to stay in Curaçao during the application process and receive an indefinite residence permit after approval.

All other foreign nationals must wait for the permit decision outside of Curaçao and receive a temporary residence permit. To maintain their stay, they must submit an application for extension before the current residence permit’s validity period expires. The longer a foreign national stays in Curaçao, the stronger their residence rights become, with 5 years of continuous lawful stay leading to fewer conditions to continue their stay and 10 years of continuous lawful stay resulting in eligibility for a residence permit with an indefinite period.

The government may reject a residence permit application for public order reasons or if the applicant cannot prove that they have sufficient financial means to support themselves and their family members. The applicant must demonstrate sustainable financial means to ensure that they won’t become a burden for taxpayers in the future. Those with a work permit have already proven their financial stability. For family reunification/formation, a fixed standard amount must be met. A rejected residence permit application for the first time doesn’t infringe on the right to family life, but a rejected renewal of the permit’s validity period does interfere with this right according to jurisprudence.
